Speaker 3: Be with you, and I just want to say one thing, still very much a candidate for governor in the state of California. I'm actually parked outside the County Elections office here in Santa Barbara County. If we have to, if we fail these appeals for getting put back on the ballot, We're going as right in. So we're definitely still in the race, even the crooked dem establishment is trying to knock me off the ballot.

Speaker 1: So could you walk us through what happened? Because this is nuts to me how you could be a candidate for office. You can just go ahead and check all the boxes, do what you're supposed to do. There's some sort of administrative problem, and instead of fixing it, they just say, oh, no, you're not allowed on the ballot. And that's the way it is.

Speaker 3: Yeah, it's even worse than you think, John, So I'll just break it down. There was actually no administrative problem, but they pretended like there was one. So here's what happened. March seventh, we submit tax returns as they are required by filing. You have to submit unredacted and redacted copies of your tax returns. The redacted ones become public, they keep the unacted. We get a message saying that they're there's deficiencies, you know, some kind of mistake in the way that we filed the paperwork. But it's a non grammatical request. They said no, no, not redacted return, not submitted. It was a triple negative. We'd figure out what it was supposed to mean three days later they correct it and say no, unredacted was submitted. And then they said this was for two years. But and then we said, well wait a minute, and the first message you said it was for four years. They wait two more days. Meanwhile, clock is ticking because they said they have to have all of this submitted the way that they want by March sixteenth, at five pm. They go back and forth, back and forth, you know, kicking the can down the road. Finally, Friday to thirteenth to ten am, we get a request with which we conmply, I'm sitting with my CPA. We submit everything that needs to be submitted, send it overnight mail. They open it at nine to seventeen am Monday morning. At four point fifty pm, they send me an email saying that if we do not correct the fact that my phone number was left unredacted in one of these fields on one hundred and thirty pages of tax returns, that they're going to throw me off the ballot. And I have ten minutes to do it in person in Sacramento. I live in Santa Barbara.

Speaker 1: You know what this sounds like to me? It sounds like to me like in the old days when they had the literacy tests at the polls, where it wasn't even really a literacy test, it was just some trick game to make sure that the Blacks couldn't vote. It seems like she's playing some sort of game with a predetermined outcome where you lost.

Speaker 3: Correct And I actually said this in a social media post. I said, Shirley Weber might as well have said to me, how many jelly beans in that jar?

Speaker 3: Because that was literally the way that they did it. And then it got even worse in court on March twenty sixth, So I hired a powerhouse Republican lawyer. Remember, I'm a Green Party candidate, not a Democrat. I've never been a Democrat or a Republican in my life. I'm an equal opportunity offender to both sides of the aisle, and I believe in an independent politic. So hired Mark Moyser, tremendously talent said Republican lawyer who had actually won the Larry Elder case when they tried to knock him off the ballot for the same foolishness back in It must have been twenty twenty two. So Mark Moyser proved in court in the Secretary of State's opposition filing two breathtaking findings. The first was that they had doctored an email thread and submitted falsified evidence into court. They went back and changed that first non grammatical request on March seventh to make it look like I had an order with which we could comply the entire time. And if that wasn't bad enough, my lawyer showed because they submitted everything that I had put a male Secretary of State, the opposition Secretary of State put this into evidence, and what my lawyer was able to show is that they actually had the correct forms, even with the redactive phone number in their possession the entire time.

So the way I see this, and I'm not a lawyer, so I don't understand the ends in the outs of the law, but just from the point of view of what seems right to me, I would imagine you're going to win in court, and I'm going to imagine that she's going to say it's too late, We've already printed the ballots. Too bad.

Speaker 3: So said, yeah, so this is the way that the game is played, right, Just to be clear, we get this on Monday at four point fifty pm. If we don't file within forty eight hours a lawsuit a writ of mandate in Sacramento County Court, we're not even going to get the case heard before they send out the voter's guide, right. So the whole thing was designed to just make me disappear before anything could be done about it. And the reason for this is simple is that I was pulling as high as five percent in January. I was two percent in December. For context, Mam Donni didn't reach two percent in his election until February. He didn't reach five percent until April. I'm five points off the leading Democrat and eight points off the leading Republicans, and they're just trying to knock me out of the race. So here's what I think that they were trying to do. They're basically they know that they're going to lose on appeal, but they're going to say it's too expensive rerun the ballots. They're going to say that there is no remedy that they can offer. And nonetheless, we are filing in court. We are filing in the original court. There's a Palestinian and Latina private citizen that is filing her own court case where she is disenfranchised. She lost fifty six family members in the genocide in Gaza, and she's saying that this is the only candidate that is willing to stand up for both sides of my family. The second thing is we are filing a circuit court appeal for this crooked judge's ruling because the judges ruling violated the laws. James argulis and he said that it didn't matter what hoops they wanted us to jump through if we didn't submit completed returns in time, there was nothing that they could do when we would be rejected. But he had just acknowledged court and the Secretary of State's lawyer had ignore knowledge that they were in possession of completed tax returns the whole time. Literally, the Secretary of State's lawyer said, it's not our job to collate the returns. That was the way that they tried to duck this. So we're appealing there and we are preparing a federal suit. We have election lawyers that have done work for the Jill Stein campaign in the past. I ran as Joe's vice president back in twenty twenty four. So we are going to fight this, and one way or the other. Even if they're successful in writing us off the balot, people can write us right back in because this is a movement. We've got people from San Diego to Humboldt. We're crossing ideological divides, identity divides. A lot of our voters are rural voters. Because I don't care who you with or who you lay with. I don't do the culture war thing. I've never been a Democrat or Republican. We're trying to restore power back to the people, all of us.

Speaker 1: The way I see this, I think she targeted you because of politics, because if you were to pull at five percent, as you said that you have some of the polls, that would mean you're going to qualify for some of the debates. And if you qualify for some of the debates, as a college professor, someone with a PhD, someone who gives lectures for a living, you're going to go out there and you're going to craft arguments that are probably going to be better crafted arguments than some of her preferred candidates. And from her point of view, you would then be a threat to her preferred candidates because you might take votes from them and in a top two primary with the threat that two Republicans could make the November ballot if you took votes from Democratic candidates because you outshine them at the debates, then that could end up with a result that she doesn't like.

Speaker 3: So I only take issue with your characterization in two ways. The first is that I would replace her with the him, because this is Gavin Newsom all the way through you. Gavin says jump and Shirley say, how high boss, Because this is definitely coming straight from the top. And I'll tell you why this is the second amendment or the second revision that I would make to your argument. It's not hypothetical. So because I'm the only candidate in the field that has received a million votes for the White House, we received almost a million votes in twenty twenty four, I was included in all of the initial debates, including so APAPA. For example, Asian Pacific American Political Association, they held a debate with all of the Democrat and Republican candidates. The people that were in that room said I won that debate hands down. Two weeks before that, SEIU Local one thousand held a debate. Only Democrats came, Katie Porter and a few others. There were seven there three and a half hours, and this has been documented and confirmed. When they closed the door and held the open vote and asked best candidate, I beat the next two candidates hands down together. And it was that point in time that people start to receive polls in their mail from Eric swall Wells campaign asking about it was basically him testing the waters for answering the race. The first four questions on those polls were about butch where because they already know what happens when I'm on a debate stage with those crooked, corrupt democratic clowns is that you just bring the body bags. It is. It's a decimation. So they're doing everything that they can to try to keep me out of the public eye. But your listeners can fix this, by the way you could. There's one live tel advised debate April twenty eighth, and it is being held by that same group a Papa CBS Sacramento, and some of you might have seen me on CBS Sacramento because I came out against Prop fifty, unlike a lot of these liberals and soak leftists that were just carrying water for the Dems. I said, you don't fight fire with fire, Bess, you fight fire with water, Bess. You don't fight jerry mandering with jerry manning, you fight it with proportional representation. So all that's to say that I've already been interviewed by CBS Sacramento. That's on the website CBS Sacramento. A PAPA and Pomona College are hosting a debate on April twenty eighth. I have already been invited to that debate, and I guarantee you now that the Democrats are going to do everything that they can to try to stop me from up here on that stage. So your listeners can call them, they can email them, they can tag them and post, and they can say, listen, we want to hear from a truly independent political candidate that isn't associated with either Team Blue or Team Red.

Speaker 1: When you show up to these debates, given the fact that they see you as a thread, how do they treat you personally? Like, how does Katie Porter treat you when you show up to these debates?

Katie Porter looks at me like she's like terrified, Like John, I'm the candy man to these people, Like I think that they're really like, are afraid if you say butch ware three times, I'm going to pop up, you know, behind them and start, you know, catching bodies like it's you can tell that they were completely blindsided and caught flat footed. The fact that they have a candidate who isn't beholden to any of the corporate interests on either side and therefore can just go guns blazing at what's wrong with the Democrat establishment inside the state of California, but without also siding with all of the things that Trump is doing crazy, you know, like trying to start World War three and threatening to nuke Iran. Right, So, the fact that I am not a liberal extremist or a conservative extremist, that I am somebody that is running on issues that are seventy thirty or eighty twenty issues for people in state of California across the ideological spectrum that has them terrified. Katie Porter looks like a deer in headlights every time she sees me.

Speaker 1: Let's go back to Shirley Weber for a second, because you mentioned Laurie Elder and she tried to kick him off the ballot. If I remember correctly, and you probably know more about this than I do, so correct me if I'm wrong. But it was she wanted certain documents. She wanted three copies of a certain document. I don't know if it was taxes or what. And he provided three copies of it, and one of the three was incomplete, but it was complete in two out of the three. And instead of allowing him the opportunity to make more photo copies of documents that she already had, she decided she was going to kick him off the ballot. Then if you go to the US Senate race the last time around, Claudia Pascucci, Christina Pascucci, damn it, I keep saying that anyway, wrong person. She was running for US Senate. She was a broadcast journalist, and they left her occupation off the ballot, so people just assumed that she was unemployed. And she goes, now, wait a minute, I filled out the paperwork the right way. I'm a broadcast journalist. Fix it, And she goes, no, no, no, no, no, we can't do that. Everything's already been printed. We'll just put a note on the website. So on the paper ballots, no one knew what she did for work. And then the third one that I can remember was for a congressional seat in Bakersfield. This is the one that Vince Fong won eventually, but he was the sitting assemblyman. He filed to run for reelection. Then the local congressman, who was McCarthy, decided he was going to get out of Congress. That seat opened up, and then he filed the paperwork to run for Congress instead of Assembly. And she goes, no, no, no, no, no, you can't do that. You already filed a run for Assembly. And he goes, yeah, well, there was an incumbent back then, but circumstances changed and she tried to keep him off the ballot, and she lost in court, just like she did with Larry Elder. And I just can't imagine how this woman thinks that she's going to be well, now, she's just going to run out the clock, is what she's going to do. But how many times do you have to lose in court do you realize that what you're doing isn't the way to run shop.

Speaker 3: But the thing is it is because they there. So I don't think that they actually that they weren't necessarily going to keep me off the ballot. I think that they wanted to make sure I do and appear in the voter's guide because they don't want people to see my resume. Listen, my father was a locksmith with a sixth grade education. I got a PhD from the University of Pennsylvania. I taught at Northwestern University, University of Michigan, and now you see Santa Barbara top research institutions. I've run multinational research centers across four continents for decades. I was doing this in my thirties. I've been an activist in the community, an organizer in the community. They don't want me on stage and they don't want people reading about me because the case that we make is compelling and its one people respond to. I think that they're just trying to keep my numbers down because they know full well that I have a great chance to finish in the top two in this primary if voters learn more about me. Last point on this or actually second to last point. I told you that. Listen, we don't accept any corporate donations. We're not swimming in cash the way either the Republican or the Democrat candidates are queans. We don't pay for our own polling. It's great when Eric Swalwell does polling for us and we find out we're two percent in December. It's great when a poll is running in January that shows us at five percent. My suspicion is that they probably have internal polling. It shows me already running neck and neck with the Democrat candidates, and they were sent to do the hit and get me out of the race. And we know that for sure this is a targeted hit because right now, you can go on Shirley Weber's web website at the Secretary of State and you can find the Libertarian candidate who they don't see as a political threat, has dozens of redaction errors in his redacted tax returns. You can go right now and find multiple candidates who have these quote unquote deficiencies in their dossiers, many many of them. So this is something that was selectively applied to me. This is lawfair, right. This is when you use the courts as a weapon of war against the political enemy. And I'm expecting people we've already seen a huge media response to this. This is already making local covers throughout the state of case California, and now they're national news outlets that are picking it up. So raise hell, because these crooked Dems are gonna if they're going to do this to me, you know for sure, they're going to do this to conservatives and to other independents. They do this to Democrats that they don't like. That same judge, thirty minutes before he jobbed me throughout the paperwork of a Democrat candidate that was running for state legislature against the California Democrat Party endorsed candidate by saying that, yeah, she had her forms, had all the fields redacted, and she submitted it to the correct county courthouse. But because she picked up paperwork from the wrong county courthouse, that they were throwing her off the ballot too. These people are rogue. They are using the courts and the Secretary of State's office to try to take out their political enemies. And I just don't think the Californias are going to put up with the consense anymore.

Speaker 3: So one thing that people do not know about Butch where is that in twenty twenty four, we were actually getting more Republican voters voting Green in the twenty twenty four presidential election in the last two polls came out. And it's for a very simple reason. Is that I got out in public and I said, listen, I do not think that your average Trump voter is racist, not any more than your average Democrat voter is racist. I said, I think that that is a fairy tale that liberals tell themselves so that they can sleep at night. I think your average Republican voter does not see a difference between blue criminals and red criminals, and all other things being equal, would rather pay lower taxes. Well, I'm going to cut those taxes because I'm not part of the Democrat machinery. I am not giving handouts to Gavin Newsom's developer but or to the poverty industrial complex. I'm going there independent to do the people's business. I work for the people. I don't work for the Democrat establishment.

Speaker 2: I guess you could say this is a preemptive attack because these allegations so far have only existed in social media. They're being investigative by reporters, but no media outlet has reported on it yet. That being said, Politico now has a story where Swalwell's campaign is denying the quote false outrageous claims inappropriate behavior. The Swallwall camp says, quote this false, outrageous rumor is being spread twenty seven days before an election begins by flailing opponents who have sadly teamed up with maga conspiracy theorists because they know Eric Swalwell is the front runner in this race.

Speaker 1: Okay, he makes a compelling argument. Here's what I think he should do. I think he should get Nancy Pelosi and all of his top female supporters to come out and publicly put their good name and reputation on the line and say that this is a MAGA conspiracy against Eric Swalwell. There's no truth to it. They all vouch for his morality and ethics, and certainly there's nothing else that'll be coming out down the pike that's about a million times worse than this. You know what's wild is no it has reported on the story yet, but now because Swalwell has to respond to it, now, this entire allegation is being covered in Politico. Yes, However, I think it was going to be inevitable. So whether it happens today or later on, I don't know. This is going to be a story that we're going to be reading a lot about, I predict. Now.

Speaker 2: There's a few more denials in the story, including a spokesperson for Swalwell's campaign, Micah Beasley. When it comes to the existence of NDAs, they're saying, in thirteen years, no one in Eric Swalwell's congressional office has ever been asked to sign an NDA. Ever, in thirteen years, not a single ethics complaint by any staff in his office or any other office has been lodged ever. Okay, that's an interesting denial because they're only talking about his time in Congress.

Speaker 1: Well? Also, if you're in Congress, sometimes they're employees of the committee. If you sit on different committees, like let's say he was on the impeachment committee to impeach Donald Trump. He sits on various committees that are standing committees in the Congress. A lot of those committees have their own employees that don't necessarily work for just you.

Speaker 2: Here's a little piece from the political story. The escalation combined with primary ballots dropping in less than a month, and specific assertations to dispute such as the NBA's was the tipping point that pushed the Swallow campaign to respond, said a campaign advisor. Granted anonymity to discuss the internal deliberations. So they know that this story is coming and they're trying to figure out how's the best way to respond to it.

Speaker 1: So here's what you do. If this is just a malicious hit, and these are people who have an axe to grind for one reason or another, don't you have an attorney send them a cease and desist letter.

Speaker 2: That's what the person who is starting to make the accusation says. They know who they are, they follow them on on social media. Nobody has gotten a cease and desist.

Speaker 1: No, no, And it's a woman who, by the way, comes from Democratic Party politics, and it's a woman who works I think she's an attorney by trade who at one point in time was a candidate herself. But she is someone who works in Democratic party politics, and I would assume wants to continue working in Democratic Party politics in the future, meaning if she comes out with some allegation that is false or defamatory, or I don't know made up her career is over. In Democratic party politics, you can't do that and then continue to get jobs. That's not how it works. Yeah, like what's in it for you? No, no, there's nothing in it. And by the way, I hate to sound like I don't know the Paul Lynn character and bye by Birdie here, but if you're a victim, there's nothing but downside coming forward. It's not fun. And I know that they're supposed to speak up and they're supposed to tell their story and know their truth and all that, and I'm glad that there are people who do it, because there are really abusive people out there. But here's what's going to happen. Swallwell is going to have opposition researchers look all of these victims up, or these alleged victims, and he's going to try to ruin their lives everything that they've ever done. If you've got a DUI, you got caught cheating on a test at some point when you were a student, whatever, that's all going to come out and they're going to put it in the paper. It is not going to be a fun experience for them. But what this really is going to do is it's going to force Democrats to ask themselves the question, do you believe Eric Swellwell? And if you believe Eric Swalwell, then you have nothing to worry about. These are fake accusations that are being politically motivated by MAGA extremists. And you don't have to worry about any additional allegations coming out at some future date. You certainly don't have to worry about any physical evidence coming out at a future date. You don't have to worry about receipts coming out at a future date that makes you look like a fool. You don't have anything to worry about like that. Nothing. And what's wild to me. What's wild to me is that they are willing and you can already see them moving in this direction to put all of their eggs in the smallwell basket, when it's clear that they were all aware that this guy had problems, because the CTA got behind him, the SEIU got behind him, Adam Schiff got behind him, their congressional delegation got behind them. They were all starting to coalesce behind him because they needed to get behind one candidate so they didn't split the vote. And then the Republicans got on the November ballot and he was clearly going to be the guy. And they either thought that the press corps wouldn't do their job and so none of this would ever come out, or that he would be able to just bat away those accusations and it would be like water off the duck's back. Now, maybe he will I don't know. Maybe he will survive this and Democratic voters in California won't care. But if the accusations get worse, maybe the situation will be different. I don't know. I can't predict the future, but I do know this. He is a slimy, smarmy, totally unethical, narcissistic attention wore. And if I had to bet, I would say there's more. Again, I'm not Nostradamis here, but if you could see me winking through the radio, you'd know. I'm pretty confident. But time will tell. Well, we have yet another poll that just dropped in the gubernatorial race here in the state of California. Boy, the second Easter ended. This campaign is really starting to heat up. This is a pole of from Create Strategies from March twenty third to March twenty ninth, polling seven hundred likely voters, and this poll shows a breakaway front runner with nineteen percent of the vote, Steve Hilton, who is still lower than the twenty percent Not sure, okay, who's in second and third?

Speaker 1: I'll tell you it'll be interesting to see what goes on with Matt Mayhan, in particular because Matt Mayhan, unlike many of the other single digit candidates, does have significant backing. You look at his contributors and it's just it's a who's who of Silicon Valley. All of the big names are there, all of the big names in Silicon Valley, and that industry, which is the industry that makes this state run, is really upset with how the state is governed, and we've seen certain companies, certain tech companies already move out. We saw Tesla move out, we saw Oracle move out, we saw SpaceX move out. There's a whole list of them, and we know that there are other companies who could be next door Dash move out to Oh it's posture, but they prefer to live here. They like it here. They just want the state to run now.

Speaker 1: All right. Here are the companies, the tech companies that have moved out of California in recent years. Gotta hope I'm gonna be able to pronounce all these names. Tesla, Oracle, Hewlett Packard, SpaceX X, Abby, Simper, Learn, McAfee, de Wave, Quantum, and Planeteer. That's AI I think right, sounds like it. I don't know anyway, they've all moved out of the state. Those people want to stay here, and Matt Mahan was their guy. That was plan a. He comes from San Jose that many of those companies are headquartered. They're very familiar with his work. They're happy with the results. Mayhan has gotten great results. I know we have listeners in San Jose, some of whom disagree, But if you compare them to the other mayors, compare them to Barbara Lee, or compare them to Karen Bass or any of the other failures, you know that San Jose is run much better than the other big cities in California. And that's what they want for the state. They want the whole state to be run like San Jose, and they've ponied up big money. However, at this point, he should be doing better than four percent, and if he's not going to do better than four percent, they're going to have to figure out what Plan B is. But now all the candidates that have been saving their money tell people were really paying attention, which is now they're all going to be filling up the airwaves. So if you're Silicon Valley and you've determined that Mayheen isn't going to make it happen the way I see things, you have three options. Option one is to get behind the other moderate Democrat in the race, who is Antonio via Ragosa. He hasn't started spending his money yet. At some point soon he will, and when he does, if you start to see a pop, then maybe that's the place to go. Option two is to flood the bank accounts of both Republicans and hope for a Republican on Republican runoff. If you get a Republican on Republican runoff, Silicon Valley would be happy with that result. The third option is to take a look at the three high performing Democrats in the polls and try to determine which one is most likely to win, and then just get behind that person. And you say, well, the unions are backing those candidates, and the unions don't believe in anything that Silicon Valley believes in, particularly with AI on the horizon, they're going to go to war with each other over things like self driving cars and trucks and that sort of thing. If the unions are going to give them X dollars, give that person, why that's more than x, and then they're beholden to you, or more beholden to you than they are to the unions. That's something that has happened before in American politics. Who was it? Was it Abraham Lincoln's secretary of war. I think was a guy by the name of Simon Cameron, where he was quoted at one point as saying, an honest politician is one who, when he's bought, will stay bought. Well, there aren't very many of those in California. My guess is they would all be willing to go to the highest bidder, So you just have to be the highest bidder. And that person, by the way, is probably Eric Swaalwell, who if Silicon Valley got behind him in a big way. He would certainly be extremely grateful, particularly right now. But I don't know what that industry is going to do. But right now they have a lot of tough questions that they need to be answering because time is ticket. It's like watching sixty minutes on Sunday nights and they're going to a commercial break. What do you hear? You hear that clock? And that's what the big wigs in Silicon Valley are hearing right now. They're hearing the clock as we get closer to the ballots being distributed in this gubernatorial election.
