Yes, yes, I'm so excited to talk about it. The testimony is unbelievable, so obvious. This man is guilty. And the wife is beautiful, incredible, brilliant nurse. She seen she seems so awesome and as a defense attorney watching this, I'm like, how did this fucking get to trial? Just to give you, like a background on the case, Ariel Koenig and Gerhart. Koenig is the defendant and Ariel is the victim. So he tried allegedly, he's on trial for attempted murder and he's looking at a potential life sentence. So they were hiking, right, yes, So the background is that he found a bunch of texts on her phone with another man.

And so they go to this hiking trail in Hawaii and according to her testimony, which because it's his ongoing this is currently in the court in Wahu, he hit her with a rock and to push to push her off a cliff. And then when she didn't go off the cliff, he took out a syringe because he's an anesthesiologist.

The son is nineteen, okay, so definitely not a girl, not yet a woman right, testified Tuesday that his father had said he tried to kill her. The son, Emil, is living with me in Hawaii now. He is no longer affiliated with Dad. Okay, he broke his record deal. He is living full time with mom.

Speaker 1: Oh yeah, Okay, so if they I mean, double Jeopardy binds when the jury seats is seated after wadier That is when Double Jeopardy sort of like is linked to the defendant, so it can't be tried again. And whatever happens, whatever that verdict is, is binding, and he could he could walk away from you walk laugh. They find that there wasn't enough evidence beyond a reasonable doubt. Yikes, I know, it's kind of crazy.

Speaker 1: So a defense attorney will it Usually I definitely advise my clients don't testify, because it's just it can go so many ways, and you've got a room full of people judging you and every word you say, and if you say one wrong thing, your toast. So that attorney definitely, we don't know what their private conversations are like, but I would imagine he advised him don't testify. But defense attorneys can't keep victims or witnesses from testifying. I mean, that's the prosecutor's whole case unless they can. What they can do is try and to peach their character on cross examination. So that's sort of how you would undercut the wife's testimony. But she said that she scooted towards the hikers on the trail and told them he was trying to kill her, was what she said.

Speaker 1: Oh the nurses found her. She's an engineer, Okay, so of anything. So basically they would have to lose the trial and then she could, I guess, face charges of attempted murder. But her entire defense will be you already tried this case on a different defendant and it didn't work, so it wouldn't be a very strong case. And she would have a strong defense if it came down to you, he said. She said her entire defense could just be this the outcome of this other trial. Like that's pretty prejudicial, okay. And so there are some really gruesome photos of her injuries. She's got like a huge cut on her head. And he said that he hit her in the head with the rock in self defense multiple times, multiple times. And she's really little, she's really tiny, and he's like like kind of I mean, he's not huge, but he's a strong man. So the notion of that happening and that he would really need a rock to push her off of him and like hit her in the head, I don't know, it doesn't seem.

It's it's the it's the violence, right, especially if if you've been in a relationship where there has not been violence, yeah, right, and then all of a sudden there is.

Violence isn't always physical, right, So I've seen a lot of And also in this case, there were accounts of emotional violence of like really narcissistic behavior on his part where he felt very controlling over her. And it wasn't necessarily fisticuffs, but it was tantamount two emotional and emotional mental psychological abase. Okay, so this was really an escalation. But this happens all the time. I know, it happens every single thing. Everything, But the happening in a relationship. And then it's like we didn't no one knew, how could we possibly know that he was going to blow up like this? But it was this one little thing. It was a powder cake.

Do you remember a few episodes back we were talking about you know, I had said that every woman has a man who right, And I do think, like, there have been times where you're so angry that you you don't know that no outlet for the anger, and the first that you want to do is to like do something to that person. And it's only your own self control, like the voice in your head that says you need to calm down immediately, that allows you to not go there, you know what I mean.

I thought I had a lot of energy, gotcha. I thought I was drinking too much coffee, which she does. But yes, yeah, seeing double vision and fly highway.

It's time. It's like how they didn't want to use shelter in place until it was like a true emergency. Now we can actually use the word concentration camp. Yeah, no, it's actually crazy. So this person wants to know if we can donate to detainees. You absolutely can, Okay. So there's a really cool nonprofit that I do work with called Jira Soul. So for example, detainees, if I get them bonded out, they literally just like open the door to the detention center in rural Georgia, and it's like good luck, kid, Like you're on your own and there's like no bus stop, there's no bus ticket, you don't have a phone, you don't have your wallet, you don't have anything. Sometimes you're mentally disabled, sometimes you're physically disabled, like and that nonprofit will work with different organizations in the area or send someone to literally like usher the person home. I have clients who were picked up in a major city in New York. They're now detained in Arizona, like ice just like shipped them so they don't know anyone. They have had no way to get home. So these nonprofits like jr Asoul have funds just for purposes, just for that.
